General

Between Elisabeth Habig, Spiegelgasse 25, 1010 Vienna, and the customer, the following general terms and conditions apply exclusively in the version valid at the time of the order. Deviating conditions of the customer are not recognized unless the seller expressly agrees to their validity in writing.

By placing your order, you accept the following general terms and conditions.

Order

The presentation of the products in the online shop is not a legally binding offer, but an invitation to place an order under the specified conditions. Service descriptions in catalogs and on the website are non-binding.

By clicking the button "order for a fee" you are placing a binding order for the goods in the shopping cart. The confirmation of the receipt of the order follows immediately after the order has been sent. We can accept your order by sending an order confirmation by email or by delivering the goods within five days.

A note: the goods shown on the website have been digitally photographed. There may be slight deviations between the presentation of the goods and the reality; such deviations do not constitute a defect in the goods ordered.

Payment modalities

The customer can choose from the available payment methods before completing the order process. For all payment methods, payment must be made in advance without any deduction.

Are third-party providers commissioned to process payments, e.g. PayPal. their general terms and conditions also apply. In the event of default in payment, the customer has to pay default interest in the amount of 5 percentage points above the base rate. The customer's obligation to pay default interest does not preclude the seller from asserting further damage caused by default.

If the seller enables prepayment, the contract is concluded with the provision of the bank details and payment request. If, despite the due date, the seller has not received the payment by 5 calendar days after sending the order confirmation, even after a renewed request, the seller withdraws from the contract with the result that the order lapses and the seller has no obligation to deliver. The order is then completed for the buyer and seller without any further consequences. A reservation of the article for prepayment is therefore made for a maximum of 5 calendar days.

Retention of title

The goods remain the property of Elisabeth Habig until full payment has been made.

Prices and shipping costs

All prices stated on the seller's website are in euros and include the applicable statutory sales tax.

In addition to the prices quoted, the seller charges shipping costs for delivery. The shipping costs are clearly communicated to the buyer on the shipping costs page and during the ordering process.

If the delivered items have obvious material or manufacturing defects, including transport damage, please report such defects to us immediately.

Delivery, availability of goods

If no copies of the product selected by the customer are available at the time of the customer's order, the seller shall notify the customer of this in the order confirmation. If the product is permanently unavailable, the seller will not make a declaration of acceptance. A contract is not concluded in this case.

If the product specified by the customer in the order is only temporarily unavailable, the seller will also notify the customer of this immediately in the order confirmation. If the delivery is delayed by more than two weeks, the customer has the right to withdraw from the contract. In addition, in this case the seller is also entitled to withdraw from the contract. The seller will immediately reimburse any payments already made by the customer.

If prepayment has been agreed, delivery will be made after receipt of the invoice amount.

Material defect warranty and guarantee

The guarantee is determined according to legal regulations.

There is only a guarantee for the goods delivered by the seller if this was expressly given in the context of the ordering process / in the product description.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods. In order to exercise your right of cancellation, you must inform Elisabeth Habig of your decision to cancel this contract by means of a clear declaration (e.g. a letter sent by post or email).

Notes on the exclusion of the right of withdrawal

The right of withdrawal does not apply to the delivery of goods that are manufactured according to customer specifications or that are clearly tailored to personal needs.

Consequences of withdrawal

If you withdraw from this contract, we will have given you all payments that we have received from you, including delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us have), to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. We can refuse the repayment until we have received the goods back.

You must return or hand over the goods to Elisabeth Habig, Spiegelgasse 25, 1010 Vienna immediately and in any case no later than fourteen days from the day on which you informed us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

The consumer bears the costs of the return shipment. The consumer is responsible for insured shipping of the goods to Elisabeth Habig, 1010 Vienna.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check the nature, properties and functionality of the goods. In addition, you can avoid the obligation to pay compensation for a deterioration caused by the intended use of the item by not using the item as if you were your own property and by refraining from anything that could impair its value.

data protection

The seller processes personal data of the customer for a specific purpose and in accordance with the statutory provisions.

The personal data provided for the purpose of ordering goods (such as name, email address, address, payment data) will be used by the seller to fulfill and process the contract. These data are treated confidentially and are not passed on to third parties who are not involved in the ordering, delivery and payment processes.

The customer has the right, upon request, to receive information free of charge about the personal data stored about him by the seller. In addition, he has the right to correct incorrect data, block and delete his personal data, as long as there is no legal obligation to retain it.

Others

The law of the Republic of Austria applies to all contracts and agreements between the customer and Elisabeth Habig.

The place of jurisdiction for any disputes is Vienna or the place of jurisdiction provided for in accordance with the statutory provisions.
